SOLAS VGM Information for Malaysia

Government approval status
All shippers are required to register themselves with Marine Department Malaysia (Jabatan Laut Malaysia) and declare the method which will be used to obtain VGM. The Marine Department requires all weighing machines to be calibrated and certified by Metrology Corporation Malaysia Sdn Bhd, validity of 2 years for parties who perform the VGM weighing.

The weight acceptance variance at:

  • Port Kelang/Penang: +/- 5%; if the variance is >5% but within the CSC weight, terminal will accept and load the container
  • Pasir Gudang / Tanjung Pelepas: +/- 500kgs; if the variance is > 500kgs but within the CSC weight, terminal will accept and load the container

Terminal will deny entry at the gate if the weight exceeded CSC weight.  
Based on above VGM verification, Terminal Operator will use the VGM for stowage planning. 

What to include in your VGM instructions to MSC
The following items are mandatory and must be on all VGM declaration to MSC
• Booking number or Bill of Lading number
• Container number
• VGM – Verified Gross Mass
• Weighing Method
• Weighing Party
• Responsible Party
• Authorized person’s signatory (submitter of the VGM who may be authorized to act on behalf of shippers
• VGM acquired time (Optional)
• VGM reference (Optional) Any missing information will be deemed as non-submission and NO LOAD.

How to submit your VGM instructions
All VGM is required to be submitted through POL terminal portal as well as to MSC via below:
- via INTTRA
- via myMSC
Manual submission by email to MY172-mscmsiavgmsubmit@msc.com . Subject Header of the Email, please indicate as:<Submit VGM- Loading Vessel Name & Voyage - MSC Assigned Booking Number>

Deadlines for sending your  VGM instructions
- VGM cut-off deadlines = Container yard (CY) cut-off time
Port Kelang: 10 hours before ETA
- Penang: 6 hours before ETA
Pasir Gudang & Tanjung Pelepas: 8 hours before ETA
NO additional plan allow after CY cut off

Admin Fees and costs
- MSC Malaysia encourages clients to declare VGM via online submission. There are no administrative charges imposed by MSC for the moment.Should there be new information, we will share with you.
- Should there be any charges levied by 3rd party or by MSC incurred as a result of NO VGM received timely, will be for Shipper’s account.

Recommendations
- It is recommended that shippers keep the VGM records for future references if required. If in doubt, always contact MSC’s local agency office.
- For Part-Load shipments – instances where there are multiple Shippers consolidating their cargo in the same container. Please appoint 1 of the Shipper to submit VGM per container to MSC.
- VGM cut-off information is available on the Booking Confirmation Form & MSC.com.
- Amendments of VGM information are allowed before the assigned deadline.

Prohibited Cargo Malaysia

It is illegal to bring the following items into or out of Malaysia.

Imports

  • Emblems or devices likely to be adverse to Malaysian interests
  • Indecent or obscene publications or articles
  • Clothes bearing imprints or reproductions of verses of the Quran
  • Broadcast receivers capable of receiving radio communication within the ranges of 68-87 MHz and 108-174 MHz
  • Pens, pencils and other articles similar to syringes
    Chemicals as follows: sodium arsenite, crocidolite, polybrominated biphenyls, polychlorinated biphenyls, polychlorinated terphenyls, trisphosphate, actinolite, anthophyllite, amosite, tremolite chlorofluorocarbons (CFCs) and halons
  • Lightning arresters containing radioactive material
  • New pneumatic snow tyres and retreaded snow tyres for all types of vehicles
  • Certain breeds of dogs as follows: Pit Bull, American Bulldog, Neapolitan Mastiff, Japanese Tosa, Akita, Dogo Argentino, Fila Braziliero (please refer to the document Import Permit for Live Animals)
  • Particular pig or pork by-products
  • Feeding bottles which contain bisphenol A (BPA) Preparations used in animal feed containing salbutamol, clenbuterol, salmeterol, terbutaline or formoterol
  • Fluid-absorbing granules for decoration purposes.

Export & Import Local Requirement

LOCAL REQUIREMENT - EXPORT

Generally, exporting goods from Malaysia to Israel is banned. The only exception is if the Malaysia’s Ministry of International Trade and Industry issues an export license.

Using Israel’s containers and/or prohibited vessel is also strictly banned. “Prohibited vessels” include:

1. All ships owned, chartered and/or operated by ZIM Integrated Shipping Services Ltd (“ZIM”);

2. All ships registered in Israel; and

3. All ships loading in Malaysian ports heading to Israeli ports.

 

LOCAL REQUIREMENT - IMPORT

Generally, importing goods from Israel to Malaysia is banned. The only exception is if the Malaysia’s Ministry of International Trade and Industry issues an import license.

Using Israel’s containers and/or prohibited vessel is also strictly banned. “Prohibited vessels” include:

1. All ships owned, chartered and/or operated by ZIM Integrated Shipping Services Ltd (“ZIM”);

2. All ships registered in Israel; and

3. All ships loading in Malaysian ports heading to Israeli ports (in cases of transshipment, if any).

 

In emergencies or Force Majeure events, the entry of Israeli goods, containers, or vessels to Malaysia will be decided on a case-by-case basis by authorities such as the Ministry of Transport Malaysia, the Malaysia Marine Department, and the relevant port authority.

Port of loading must check with the following key person-in-charge for approval before loading the cargo on board vessel:

Exchange Controls

Foreign exchange control in Malaysia is governed by the Exchange Control Act, 1953, under which the Controller of Foreign Exchange, who is also the Governor of Bank Negara Malaysia, the central bank, is empowered to regulate foreign exchange dealings in Malaysia.

The Act imposes general restrictions on foreign exchange dealings by residents and non-residents. No person is allowed, among others, to buy or borrow foreign currency from, or sell or lend foreign currency to, any person; to make any payment in Malaysian ringgit to a non-resident in and outside Malaysia; or to deal in ringgit assets in Malaysia without the prior permission of the Controller.

There are no restrictions for non-residents to invest in Malaysia to purchase ringgit assets, such as landed property and securities. There is also no restriction for non-residents to transfer abroad, in foreign currency, all profits, returns and divestment proceeds from their investments in Malaysia.

Shipping Requirements Malaysia

6-Digit HS Code Mandatory for Manifest Submission Effective 01/Oct/2018

A minimum of 6-Digit HS Code is mandatory in manifest submission to current local customs authority SMK system effective 01/Oct/2018. 
Effective Date : 01/Oct/2018 (based on vessel ETA at Port of Loading, vessel discharged and transshipment at Malaysian ports dated on 01/Oct/2018)  
Manifest Type : Export, Import and Transshipment 
Affected Ports : All MY ports 
POL offices are required to furnish mandatory 6-digit HS Code in the cargo manifest / DTX as stipulated by the Royal Malaysian Customs Department without compromise. 
POL offices should manifest the HS Code per cargo basis if the shipment have more than 1 commodity in 1 container. 
Failure to do so, POL office will be held responsible for all charges incur and cost will be bill back to your respective office. 
Note: FROB shipment not affected by this requirement, applicable to transshipment and local discharge in Malaysia only.  
 
Following documents and information have to submit to relevant authorities 48 hours before vessel arrival; 
1) Import Cargo manifest with full style of Company Name, Address, Tel and Fax # of Malaysian Receiver. 
2) Vehicle Import 
Following information require for Vehicle import 
  • Chassis number 
  • Engine number 
  • Colour of Vehicle 
  • Type of Vehicle 
  • Manufactured year 
  • Fuel - Petrol or Diesel 
All the above information has to be sent to POD at least 3 days prior to vessel arrival.

Full Contact details (company name, address, phone & fax) of Malaysian Receiver/Cnee and Notify in the manifest are needed for Customs clearance 
6 digits HS Code is mandatory to be manifested for import into Malaysia (effective 1st August 2009) 
 
Importation of Rubber & Plastic Scrap: 
  • All importations of Plastic Scrap & Rubber Scrap into Malaysia will requires special approval permit (A/P) from the Malaysia Ministry Of International Trade And Industry (MITI) & Ministry of Natural Resources And Environment (DOE). 
  • All POL agents are required to firstly check with respective Malaysian POD before acceptance of booking for said commodity and provide full shipper & consignee details for reference checking with the Ministries involved for the authentic & verification of A/P validity.   
  • Rubber Scrap / Tyre Scrap / Shredded Tyre / Shredded Rubber
  • Plastic Scrap/ Plastic Waste

Applied at Tanjung Pelepas Port
 
The Enforcement of new ruling from MAQIS (Malaysian Quarantine & Inspection Services) under the Ministry of Agriculture and Agro-Based Industry Malaysia  
Effective 24/09/2021, as instructed by MAQIS Director General, any application for reworking/ transloading for container with commodities of agriculture, animal & fish relating to food product and for matters related to it, will have to obtain approval from MAQIS prior to reworking/ transloading activity. 
Under this requirement, any warehouse operators need to obtain MAQIS approval before they could proceed with rework activity (food items). 
Application shall be made to MAQIS through a letter supported with ZB1 and BL 1 day before the rework activity takes place. 
MAQIS will approve the application within 1 calendar day (MAQIS PTP is operating 24 hours daily except Public Holidays).
